On Thursday, February 4th, the Massachusetts Senate approved the Wind Energy Siting Reform Act. The bill was so controversial that not one senator requested a roll call vote. Instead, the Senate president approved the bill with a gavel vote, so no votes are on record.

However, during the Senate session, Senator Ben Downing from the Berkshires said he favored the bill, as did Senator Bob O’Leary from the Cape and Islands. Their districts will be most damaged by the bill.

We are particularly disappointed in the role of Senator Downing throughout the process. He was on the committee that drafted the Act. He was on the Senate Ways & Means committee that reported out the Act essentially unchanged. He said repeatedly that he was given great deference by the Senate leadership on the Act. A number of his colleagues and their staffers told me that the Act survived because of him. And yesterday, although almost all of his amendments (which were not much to begin with) failed, he spoke out in favor of the Act.

He did this despite opposition to the Act from two regional planning agencies collectively representing 58 towns, from groups representing sportsmen and women, from environmental groups in his district, and many people in his district, hundreds of whom signed a petition.

The Act, as it was approved by the Senate, will allow the state to override local zoning decisions about the permitting of industrial wind facilities, replace environmental laws with “standards” that can be applied or waived by the state, and eliminate traditional rights of participation and appeal by citizens and communities.


The Act now moves to the House, where it could be taken up at any time.
